Terms of Service

1. Acceptance of Terms

By downloading, installing, or using TrendBody ("the App"), you agree to be bound by these Terms of Service, including the indemnification obligations in Section 11, the assumption of risk in Section 12, and, where applicable, the class action waiver in Section 17. If you do not agree to these terms, do not use the App.

2. Age Requirement

You must be at least 18 years old (or the age of legal majority in your country of residence) to use TrendBody. By using the App, you represent and warrant that you meet this age requirement.

3. Description of Service

TrendBody is a weight tracking application for iOS that provides trend analysis, caloric balance estimates, and goal forecasting. The App integrates with Apple HealthKit and stores all data locally on your device.

4. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes, subject to these Terms and the Apple Media Services Terms and Conditions.

5. Purchases

TrendBody offers a one-time in-app purchase ("Pro") that unlocks additional features. All purchases are processed through Apple's App Store and are subject to Apple's refund policies. The Pro purchase includes Family Sharing support.

6. Free Trial

TrendBody may offer a free trial period for Pro features. At the end of the trial, Pro features will be locked unless you make the one-time purchase. No automatic charges occur — there are no subscriptions.

7. Medical Disclaimer

TrendBody does not provide medical, nutritional, or health advice. Any caloric estimates, trends, or forecasts are mathematical approximations based on models and should not replace professional medical guidance. Consult a qualified healthcare provider before making any changes to your diet or exercise routine.

All caloric estimates, equilibrium projections, goal date forecasts, and pace indicators are mathematical approximations based on population-level models and are not personalized medical advice. They do not account for individual medical conditions, medications, metabolic disorders, or other personal health factors.

Weight tracking applications may be triggering for individuals with eating disorders or a history of disordered eating. If this applies to you, do not use this app without prior approval from a qualified healthcare professional.

You acknowledge that you use the App's outputs at your own discretion and that the developer has no way to verify your individual health circumstances.

8. Acceptable Use

You agree not to:

  • Reverse engineer, decompile, or disassemble the App
  • Use the App for any unlawful purpose or in violation of any applicable laws
  • Attempt to access data or features not intended for your use
  • Redistribute, sublicense, or resell the App

9. Intellectual Property

The App, including its design, code, algorithms, icons, and content, is owned by TrendBody and protected by intellectual property laws. All rights not expressly granted are reserved.

10. Limitation of Liability and Disclaimer of Warranties

To the maximum extent permitted by applicable law, TrendBody and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or in connection with your use of the App.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITH ALL FAULTS AND WITHOUT ANY WARRANTIES OR REPRESENTATIONS OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NONINFRINGEMENT. WE MAKE NO WARRANTY THAT THE APP WILL MEET YOUR REQUIREMENTS, OPERATE WITHOUT INTERRUPTION, OR BE ERROR-FREE.

In any event, our total aggregate liability to you for all claims arising from or related to your use of the App shall not exceed the amount you actually paid for the App in the twelve (12) months preceding the claim. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence.

11. Indemnification

To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless TrendBody, its developer(s), officers, employees, agents, affiliates, and successors (collectively, the "Indemnified Parties") from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees and litigation costs) arising out of or in any way related to:

  • your use or misuse of the App, including any forecasts, caloric estimates, goal-setting features, or other content provided by the App;
  • any breach by you of these Terms;
  • your violation of any applicable law or regulation;
  • any claim that your use of the App caused or contributed to any personal injury, health issue, or other harm; or
  • your gross negligence or willful misconduct.

We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate fully with us in asserting any available defenses. You will not settle any claim without our prior written consent.

12. Assumption of Risk

To the maximum extent permitted by applicable law, by using TrendBody, you acknowledge and voluntarily assume all risks associated with weight tracking, including but not limited to: psychological effects of monitoring body weight, potential triggering of disordered eating behaviors, reliance on mathematical estimates that may not reflect your individual physiology, and setting or pursuing weight goals without professional medical supervision.

You represent that you have consulted with, or have had the opportunity to consult with, a healthcare professional regarding the appropriateness of weight tracking for your personal circumstances.

13. Data and Privacy

Your use of the App is also governed by our Privacy Policy. TrendBody stores all data locally on your device and does not collect personal information.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes through the App or on this page. Changes will be posted with an updated revision date. Continued use of the App after the effective date of any changes constitutes acceptance of the revised Terms.

15. Apple App Store

These Terms are between you and TrendBody only, and not with Apple Inc. ("Apple"). Apple is not responsible for the App or its content. Apple has no obligation to provide any maintenance or support services for the App.

In the event of any failure of the App to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the App.

Apple is not responsible for addressing any claims by you or any third party relating to the App, including product liability claims, any claim that the App fails to conform to any applicable legal or regulatory requirement, or claims arising under consumer protection or similar legislation.

You must comply with any applicable third-party terms when using the App, including Apple's Media Services Terms and Conditions. Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, Apple will have the right to enforce these Terms against you as a third-party beneficiary.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

17. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Finland and the European Union, without regard to conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Finland.

Class Action Waiver

To the extent permitted by applicable law (particularly for users in the United States), you agree that any disputes arising out of or relating to these Terms or the App will be resolved on an individual basis. You waive any right to participate in a class action, class arbitration, private attorney general action, or other representative proceeding against us. You also waive any right to a jury trial in connection with any such dispute. This waiver applies to the maximum extent permitted by law.
